As an independent contractor of CAREPATH TRANSIT LLC (“Company”), I will perform the following duties and obligations attached as Exhibit “A” (“Duties and Obligations”). I will assume all risks of harm, damage, liability, injury and loss associated with, related to or potentially arising from or related to performing said Duties and Obligations. I understand that participating in any Duties and Obligations can be a dangerous activity involving risk of injury, loss of limb(s) and/or even death.

• In consideration of payment received by and to be received by Company for services related to the Duties and Obligations, I fully and irrevocably release, waive, discharge and covenant not to sue Company, its officers, executives, employees, independent contractors, and agents from all liability to me, and to my representatives, assigns and heirs for any and all loss, arrests, liability, damages or expense whenever arising or discovered, and for any claim or demands on account of or related to any injury to me, including my death, and any damage to my property that may result from my performance of the Duties and Obligations, including injury, criminal arrest, loss or damages caused in whole or in part by the negligence of Company or its officers, executives, employees, independent contractors, and or any violation of the Florida Law.
• I will indemnify, and at Company’s request, defend, and hold harmless Company and its officers, executives, employees, independent contractors, and agents, from all damages or expenses incurred by reason of any third party claim for injury, loss or damages to me which I have released, waived or forever discharged in this Release.
• In addition, I assume all liability for, I am responsible for, indemnify, and hold harmless Company and its officers, executives, employees, independent contractors, and agents against any loss, liability, arrest, damage, or expense arising from any actual or claimed death or injury to any person or actual or claimed damage to property, whether owned by me, Company or third parties, including loss of use, that actually or allegedly results from my conduct, by act or omission, relating to my participation in the Duties and Obligations.
• Furthermore, I understand that participation in the Duties and Obligations requires me to drive a vehicle. I hereby fully and irrevocably release, waive, discharge and covenant not to sue Company and its officers, executives, employees, independent contractors and agents from liability to me, and/or others who decided to drive my vehicle while participating in Duties and Obligations.
• This Release shall be governed by and construed in accordance with the laws of the State of Florida, without regard to the conflict or choice of laws principals of the State. Venue for all actions and proceeding arising out of this Agreement shall be in the Courts of Hillsborough County, Florida.
• Should Company and its officers, executives, employees, independent contractors, and agent retain an attorney or attorneys to enforce any of the provisions of this Release or to protect its interest in any matter arising under this Release, I agree to pay all reasonable costs, charges and expenses, including reasonable attorney's fees, expended or incurred in connection therewith.

I HAVE READ THIS RELEASE AND AGREE TO BE BOUND BY THIS RELEASE. I UNDERSTAND THAT THIS RELEASE BARS ME AND MY HEIRS, ASSIGNS AND REPRESENTATIVES FROM ANY RECOVERY FROM COMPANY, INCLUDING ITS OFFICERS, MANGERS, OWNERS, VOLUNTEERS AND AGENTS, FOR INJURY, DEATH, ARREST, LOSS OR DAMAGE TO ME AND FOR DAMAGE, ARREST, AND LOSS OF PROPERTY THAT RESULTS FROM OR IS RELATED TO MY PERFORMANCE OF THE DUTIES AND OBLIGATIONS. AS SET FORTH ABOVE. I ALSO UNDERSTAND THAT THIS RELEASE RELEASES AND FOREVER DISCHARGES COMPANY, ITS EXECUTIVES, EMPLOYEES, INDEPENDENT CONTRACTORS, AND AGENTS, FROM ANY AND ALL LIABILITY FOR ANY INJURY, DEATH, ARREST, LOSS OR DAMAGE TO THIRD PARTIES RESULTING FROM OR RELATED TO MY PERFORMANCE OF THE DUTIES AND OBLIGATIONS.
